It is an online platform for Universities, Colleges, Schools & Training Centres (Course Provider) who provide course programme (Courses) and prospective students (Learners) who post their course/ learning needs (Course Interest) and Advertisers / Marketers.
1. Acceptance of Terms
Your access to and use of studyinuk.com ("the Website") and the Services defined below are subject exclusively to these Terms and Conditions.
You agree not to use the Website and/or Services for any purpose that is unlawful or prohibited by these Terms and Conditions.
By using the Website and/or Services you are fully accepting the Terms and Conditions. If you do not accept these Terms and Conditions you must immediately stop using the Website and/or Services.
We reserves the right to update or amend these Terms and Conditions at any time and your continued use of the Website and/or Services following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.
We may update the Website from time to time, and may change the content at any time without any prior notice.
2. Access to the Website
We do not guarantee that the Website or any content contained on the Website will always be available or be uninterrupted.
You are responsible for making all arrangements necessary for you to have access to the Website.
Your access to the Website is permitted on a temporary basis only. We may suspend, withdraw, discontinue or change all or any part of the Website without notice to you. We will not be liable to you for any reason if the Website is unavailable at any time or for any period.
Although we makes reasonable efforts to update the information on the Website, please note that the content contained on the Website may be out of date at any given time and we are under no obligation to update it.
3. Eligibility
You must be 16 years of age or over to register on this Site.
4. Learner's Account Registration
The Site is completely free for learners to use. There are no charges to post the course interest to request for quotation/proposal.
Learners can post any number of the course interests to request for Quotation/Proposal from Course Providers. When posting the course interest, Learners will be asked a number of questions to enable Course Providers to understand the project requirements for Course Interest, if possible.
Course providers need to purchase credits from us in order to provide Learners with a proposal/quotation but the only fee Learners may be liable for is the course fees for any courses as agreed between the Learner and the Course Providers.
We will send each Request to a selection of relevant Course Providers to review and decide if they want to contact the Learner at our discretion.
If a Course Provider chooses to provide a proposal/quotation, the Learner will receive a message from the Course Provider and/or a phone call to discuss the course requirement in details.
5. Course Provider Account Registration & Profile
Registration is required to become a Course Provider on the Site. In order to make the platform as trustworthy, secure and safe as we can without providing any personal endorsements, we endeavour but have no obligation to carry out some basic ID checks. Registration is subject to agreement by us in all cases, and we reserve the right, in our sole and absolute discretion, to decline any application for registration, without providing any reason.
Course Provider must ensure that any registration details provided are accurate. To register an account with us, accurate, complete and up-to-date contact information must be provided, including name, postal address as it appears on government-issued identification, the legal name and details of business, telephone number, email address, and profile photo or company logo.
This profile is accessible to the public and to Learners.
The profile may evidence the courses through images and videos, and may include reviews from past learners and peers.
Reviews will help show Learners the details of course programme but we do not guarantee or warrant the accuracy or authenticity of any review left about a Course Provider and Learners should undertake their own checks to confirm such reviews.
6. Our Role
This Site is an online platform where Learners post their Course Interest in an expectation to receive a quotation/proposal from Course Providers and for Course Provider buys credits to respond to Course Interest requirements with a proposal/quotation.
If the Learner wishes to proceed with a proposal, the Course Provider and the Learner shall contract directly with each.
We do not guarantee that the Learners will receive a quotation/proposal from Course Providers by posting their Course Interest. We also do not guarantee that the Course Providers who buy our credits to contact/respond to the Course Interests will receive enrolments from Learners. We do not provide courses, or make any representation or warranty about Learners, their likelihood to select Course Providers, and we are not responsible for the obligations of Course Providers or Learners. We have no obligations regarding Learners' payments (or any other obligations of Learners), which remain their sole responsibility under their direct contract with Course Provider. Equally we are not responsible for Course / Course Deliveries or any problem or delay in providing them, or for any dispute over the amount due to be paid by Learners.
7. Credits
Course Providers need to purchase credits from us in order to provide Learners with a proposal/quotation.
All charges payable by Course Providers to purchase our credits shall be in accordance with the scale of charges and rates published from time to time by us on this site, errors and omissions accepted, and shall be due and payable in advance. You agree that, except where otherwise specified in these terms, these fees are not refundable on any basis.
We reserve the right to alter price of our Credits without any further notice.
All fees paid to us are non refundable except in circumstances set out in these Terms. You also agree not to issue a chargeback via your bank in relation to any fees charged by us. If you do so you accept that you will be liable for our costs in dealing with the chargeback and recovering any fees properly due to us under the Terms.
8. Users' (Learners and Course Providers) Content
Content must:

be relevant to the purpose of the Site;

where it states facts, be accurate to the best of you knowledge, information and belief; and

comply with applicable law in the United Kingdom and in any country from which it is submitted.
Content must not:

be unlawful in any way;

contain any material which infringes any intellectual property right or other right of any other person;

be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence or data protection obligations;

contain fraudulent information;

contain any material which is defamatory of any person or entity;

be likely to mislead or deceive any person;

be used to impersonate any person, or to misrepresent a Learner's identity or affiliation with any person;

contain any material which is obscene, offensive, hateful or inflammatory;

be menacing, threatening, abuse or invade another's privacy, or cause harassment, anxiety, alarm, upset, embarrassment, annoyance or inconvenience to any person;

contain or promote sexually explicit material;

promote violence or aggression;
-
promote discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
-
encourage, advocate, promote, solicit, invite or assist any illegal activity or unlawful act such as (by way of example only) intellectual property infringement or computer misuse;

be used to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);

disrupt the normal flow of dialogue with an excessive amount of Learner Content (flooding attack) to the Site, or that otherwise negatively affects other users' ability to use the Site;

contain any viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;

be posted by a third-party agent, service, or intermediary that offers to post content on behalf of others without express permission from us; or
-
give the impression that it emanates from us, if this is not the case.
9. Limitation of Liability
The Site is an online platform, which is intended to allow Course Providers and Learners to connect with each other. Subject to the provisions of this Section, we are not responsible for and disclaim any and all liability related to the provision of Services as between Course Providers and Learners.
Learners agree that the use of the Site and course enrolment Web Agencies /IT Professionals for IT Services is entirely at their own risk. We are not liable for validating any Course Providers.
Nothing in these Terms shall limit or exclude our liability to Learners for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation or any other liability that under English law may not be limited or excluded.
Our total liability arising under or in connection with these Terms or any breach or non-performance of these Terms no matter how fundamental (including by reason of negligence) in contract, tort or otherwise shall be limited to £10.
10. Termination of an Account
We may terminate your account upon your request at any time.
We may, at our discretion where we consider this reasonably necessary (for example if a Learner is in breach of these Terms), immediately terminate their account and all access to the Site without prior notice.
We will not be liable to Learners and Course Providers or any third party for the termination of their account.
11. Governing Law and Jurisdiction
These Terms are governed by English law, and any dispute will only be dealt with by the English courts. Nothing shall prevent us from bringing proceedings to protect our intellectual property rights before any competent court.
